The Beer Board for the City of Crossville, Tennessee met in special session on Tuesday, March 11, 2008 at Crossville City Hall.

 

Roll Call.

Present: Councilman Carl Duer, M.D, Councilman Earl Dean, Mayor J. H. Graham, III, Mayor Pro-Tem Boyd Wyatt, Sr.; Absent/Excused: Councilman Jesse Kerley.  Others present were Interim City Manager Mike Turner, City Clerk Sally Oglesby, Chief David Beaty, Capt. Mark Rosser, Tim Begley, Fred Houston, Jose Avila Reza, Humberto Avila, Sandy Whitehead, Mike Moser, Kim Lemons, Earl O. Brown, and Wade Davis.

 

            Mayor J. H. Graham, III was present and presiding.  The meeting was called to order at 5:00 p.m.

 

Police Chief Beaty reported that he had received complaints against both establishments and compliance checks were conducted.  Capt. Mark Rosser stated that the compliance checks were held on February 6, 2008.  An auxiliary officer and an underage individual both had their ID’s checked and were served alcoholic beverages.  They appeared under City Court on February 19, 2008 and were put on six months’ probation since they were first offenses.  No fine was issued by Judge Bean.  They have both taken steps to tighten up their operations.  Las Margueritas permit holder was the server, but claimed a language problem and misreading of the licenses.  The Beer Board was advised of their options to fine, suspend, or revocake the license. 

 

 

ITEM #1 – REDHEADS BAR & GRILL

 

            Redheads Bar & Grill, located at 224 Peavine Road, was cited for violations pertaining to the sale of beer to a person under twenty-one (21) years of age.  Wade Davis and Kim Lemons stated that the employee was new and has since taken and passed the ABC class.  They have hired 3 security officers and retrained all of their employees on the law.  The employee assumed that the ID had been checked at the door by security.  They reported that ID’s are now being checked at the door and by the servers. 

 

            A motion was made by Councilman Dean, seconded by Councilman Duer, that Redheads Bar & Grill be given a six-month probation to run concurrently with the City Court action, which began February 19, 2008.  Vote: Motion carried by unanimous roll call vote (summary: Yes = 4).  Yes: Councilman Carl Duer, M.D, Councilman Earl Dean, Mayor J. H. Graham, III, Mayor Pro-Tem Boyd Wyatt, Sr.; Absent: Councilman Jesse Kerley.

 

 

ITEM #2 – LAS MARGARITAS

 

            Las Margaritas, located at 72 Woodmere Mall, was cited for violations pertaining to the sale of liquor to a person under twenty-one (21) years of age.  The permit holder stated that he saw the ID, but because of the lighting, he misread the year to be 1986 instead of 1988.

 

            A motion was made by Councilman Duer, seconded by Councilman Wyatt, that Las Margaritas be given a six-month probation to run concurrently with the City Court, which began February 19, 2008.  Vote: Motion carried by unanimous roll call vote (summary: Yes = 4).  Yes: Councilman Carl Duer, M.D, Councilman Earl Dean, Mayor J. H. Graham, III, Mayor Pro-Tem Boyd Wyatt, Sr.; Absent: Councilman Jesse Kerley.
