The Beer Board for the City of Crossville, Tennessee met in special session on Tuesday, February 12, 2008, at Crossville City Hall.

 

Roll Call.

Present: Councilman Earl Dean, Councilman Jesse Kerley, Mayor J. H. Graham, III, Mayor Pro-Tem Boyd Wyatt, Sr.  Absent/Excused: Councilman Carl Duer, M.D.  Others present were Interim City Manager Mike Turner, City Clerk Sally Oglesby, John Lambert, Bobby L. Lambert, Cindy Barnett, Richard Barnett, Andrea L. Cravens, Jim Young, Christy Lewis, Major Darrell Sherrill, and ABC Special Agent Nathan Bradley.

 

            Mayor J. H. Graham called the meeting to order at 4:00 p.m.

 

 

ITEM #1 – MATTERS PERTAINING TO CHARGES AGAINST THE FOLLOWING BEER PERMIT HOLDERS FOR THE SALE OF INTOXICATING LIQUOR IN VIOLATION OF CROSSVILLE MUNICIPAL CODE 8-212(5):

            B J’s Lounge located at 47 Lantana Road

            Porky’s Bar-B-Que located at 1017 Lantana Road

            R & B’s Café located at 518 S. Main

 

            The Alcoholic Beverage Commission served search warrants on these businesses on January 24, 2008 and citations were issued as follows:

 

  • B J’s Lounge – Bobby Lambert-Beer Permit Holder:  Possession of Gambling Devices; Illegal sale of liquor by employee Sheila Yates
  • Porky’s Bar-B-Que – Andrea Lewis-Beer Permit Holder:  Illegal sale of liquor by employee Shanna Lowery
  • R & B Café – Cynthia Barnett, Richard Barnett & William Randolph-Beer Permit Holder:  Illegal sale of liquor by employee Kristi Vanvorhes

 

Major Darrell Sherrill and Special Agent Nathan Bradley of the Tennessee Alcoholic Beverage Commission presented the cases and the statutes which were violated.  City Attorney Kenneth Chadwell stated that the Beer Board’s actions are limited to suspension of up to six months or revocation.  The State’s case for B J’s Lounge has been continued until April 17, 2008.  Mrs. Bobby Lambert stated that she will have an attorney to defend her.

 

            A motion was made by Councilman Wyatt, seconded by Councilman Kerley, that any actions be deferred on B J’s Lounge until the court rules on the case.  Vote: Motion carried by unanimous roll call vote (summary: Yes = 4).  Yes: Councilman Earl Dean, Councilman Jesse Kerley, Mayor J. H. Graham, III, Mayor Pro-Tem Boyd Wyatt, Sr.  Absent: Councilman Carl Duer, M.D.

 

            The State’s case for Porky’s Bar-B-Que has been continued until April 17, 2008.  Mrs. Andrea Lewis asked for clarification on a charge shown in the newspaper about an employee having marijuana on their person.  Agent Bradley stated that no charges, at this time, have been filed in that matter.

 

            A motion was made by Councilman Kerley, seconded by Councilman Dean, that any actions be deferred on Porky’s Bar-B-Que until the court rules on the case.  Vote: Motion carried by unanimous roll call vote (summary: Yes = 4).  Yes: Councilman Earl Dean, Councilman Jesse Kerley, Mayor J. H. Graham, III, Mayor Pro-Tem Boyd Wyatt, Sr.  Absent: Councilman Carl Duer, M.D.

 

            The State’s case for R & B Café has been continued until April 17, 2008. 

 

            A motion was made by Councilman Wyatt, seconded by Councilman Kerley, that any actions be deferred on R & B Café until the court rules on the case.  Vote: Motion carried by unanimous roll call vote (summary: Yes = 4).  Yes: Councilman Earl Dean, Councilman Jesse Kerley, Mayor J. H. Graham, III, Mayor Pro-Tem Boyd Wyatt, Sr.  Absent: Councilman Carl Duer, M.D.

 

            The Police Department was asked to bring the disposition of the court back to the Beer Board.
